Every project gets a fixed written quotation. You pay a deposit and then by milestone. Once you've paid in full, you own the work we made for you. If a project quotation or agreement says something different from these terms, the quotation or agreement applies.
These Terms apply to your use of this website and to services provided by Transfomind ("we", "us"). By using this website or engaging our services, you agree to them.
1. Using this website
- Content on this site is general information, not professional advice for your specific situation.
- Prices shown are typical starting points in Malaysian ringgit. Your actual price is set in your written quotation.
- Sample websites and dashboards on this site use fictional businesses and sample data.
- Please don't misuse the site, for example by trying to disrupt it or access it without permission.
2. Quotations and scope
- After a discovery call we send a written quotation setting out the scope, deliverables, milestones and price. Unless it says otherwise, a quotation is valid for 30 days.
- Work outside the agreed scope is treated as a change request. We'll explain the extra cost and time first, and only go ahead once you approve it in writing.
3. Payments
- Projects start once the deposit is paid. The balance is paid by agreed milestones, after you've reviewed and approved the work for each milestone.
- Invoices are payable within the period stated on the invoice. If payments are overdue, we may pause work until they are settled.
- Domains, hosting, paid plugins and third-party subscriptions are charged separately, and their providers may change their prices.
4. Your responsibilities
- Provide content, information, access and feedback on time, so the project can stay on schedule.
- Make sure you have the right to use any text, images, logos or data you give us.
- Use the websites and systems we deliver lawfully, including your own obligations under the Personal Data Protection Act for your customers' data.
5. Ownership
- Once you've paid in full, you own the final deliverables created specifically for you, such as your custom design, content and custom code.
- Third-party and open-source components, and our own pre-existing tools and know-how, remain with their owners. You receive the right to use them as part of your deliverables.
- We may show completed work in our portfolio unless you ask us not to.
6. Third-party services
Our work often connects to third-party services such as hosting, WhatsApp, Google Workspace and payment gateways. These are governed by their own terms, and we aren't responsible for their outages, policy changes or price changes.
7. Support and fixes
- We fix defects in our work that you report during the support period stated in your quotation. For custom systems this is normally 30 days after launch.
- After that, updates and fixes are covered by a maintenance plan or quoted as separate work.
8. Liability
- We carry out our work with reasonable care and skill.
- We are not liable for indirect or consequential losses, such as lost profits or lost data caused by third-party services.
- Our total liability for any project is limited to the fees you paid us for that project.
- Nothing in these terms limits any liability that cannot be limited under Malaysian law.
9. Ending a project
Either of us may end a project by written notice. You pay for work completed up to that date. The deposit covers work already started and is non-refundable once work has begun, unless your quotation says otherwise.
10. Confidentiality
We keep your business information confidential and use it only to deliver your project, unless you agree otherwise or the law requires disclosure.
11. Governing law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute.
12. Changes and contact
